T E R M S    A N D    C O N D I T I O N S

RELATING TO THE EMPLOYMENT OF

TPFLArchitects

1) For homeowner projects Architectural Services fees are payable in two stages as set out in our fee agreement pro-forma;

a) 50% of the planning fee is payable on completion of the site survey, the balance of the planning fee is payable at the time of submission of the planning application.

b) 25% of the Building Regulation fee is payable at grant of planning consent, the balance of the Building regulation fee is payable on submission of the application.

c) FOR BUILDING REGULATION ONLY APPLICATIONS 50% of the Building Regulation fee is payable at grant of planning consent, the balance of the Building regulation fee is payable on submission of the application.

2) For full project management services, fees are payable at fixed work stages and fixed percentages which are set out elsewhere in this document and will be stated in the appointment agreement.

3) For homeowner projects a short fee agreement pro-forma will be set up which will identify the services to be provided and the fees to be paid. We will sign the agreement together with our client and a copy will be given to the client.

4) For full project management services an appointment agreement will be set up which will identify the range of services to be provided, the fees to be paid and the responsibilities of client and architect. We will sign the agreement together with our client and a copy will be given to the client.

5) Payment of invoices is within 14 days, unless stated otherwise. In the event of an invoice running more than 5 working days overdue, we are unable to proceed with the next work stage of the project until either payment is received or a valid reason for non-payment is given. Interest will be charged at 4% above base rate on any outstanding amounts after 30 days from date of invoice, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, until payment in full has been made (a part of a month being calculated as a full month for the purpose of calculating interest.)

6) The copyright in all drawings and documents remains with TPFL Architects at all times.

7) We can accept no liability for errors and/or lack of information in the documents provided by any third party.

8) Liability of TPFL Architects for any error or claim shall be limited to such sum as ought reasonably to be paid having regard to responsibility for the loss or damage suffered as a result of the occurrences in question and on the assumption that all other Consultants and all Contractors and Sub-Contractors have paid to the Client such proportion which it would be just and equitable for them to pay having regard to the extent of their responsibility.
